Disclaimer of Warranties and Limitation of Liability

To the extent permitted by mandatory consumer law, we will only be responsible for costs incurred as a direct result of our failure. This means that, to the extent allowed by law, we will not be responsible for, for example, any:
- Indirect loss or damage.
- Inaccurate information about the service provider.
- Product, service, or action by another service provider or business partner.
- Incorrect email address, phone number, or credit card number (unless the error is on our part).
- Force majeure or an event beyond our control.
If you violate these terms and/or the service provider's terms, to the extent permitted by law:
- We will not be responsible for any costs incurred as a result.
- You will not be entitled to a refund.
To the extent permitted by law, our maximum liability, or that of any service provider (whether for a single event or a series of connected events), is the cost of your booking as stated in the confirmation email.
Nothing in these terms limits our liability (or the service provider's liability) for (a) negligence leading to death or personal injury, or (b) fraud or fraudulent misrepresentation.
You may be protected under mandatory consumer protection laws and regulations, which ensure rights that cannot be waived by the terms of any company. In such cases, our liability will not be limited solely by these terms, but also by any applicable consumer protection laws and regulations.
We do not warrant or guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. We do not guarantee that the results obtained from using the service will be accurate or reliable.
You agree that we may, from time to time, remove the service for indefinite periods or cancel the service at any time without notice. You explicitly agree that your use or inability to use the service is at your own risk.
We reserve the right to block access and/or modify or delete any material that, in our reasonable discretion, violates these Terms and Conditions of Use.
We do not guarantee that the application will always be available, uninterrupted, timely, secure, free from errors, or free from viruses or hacking and sabotage, nor that the application will not be affected by force majeure or events beyond our control, including the failure or inability to obtain necessary materials, equipment, devices, power, or communication channels, or lack of communication equipment or services, or IT failure or communication equipment failure, or other equipment failures.
We are not responsible for any acts or omissions by any third party for any reason, and for any direct, indirect, incidental, special, consequential, or punitive damages arising in any way in connection with the site, application, or services provided on the application, or for your access to or use of the application, inability to use the application, reliance on the application and/or services, or downloading from it, or for any delays, inaccuracies in the information, or transmission thereof, including but not limited to damages resulting from business losses, profits, use, data, or any other intangible loss, even if we have been advised of the possibility of such damages.
We are not responsible for breaches of contract or duty (including negligence or breach of any legal right) or in any way, for any reason, or breach of any loss or damage that occurs in connection with the relationship with the application and these Terms and Conditions of Use. In these Terms and Conditions of Use, such loss or damage includes, but is not limited to, loss of revenue, profits, savings, business opportunities, data, reputation, or interest in or value of any equipment, including software, third-party claims, and all incidental and associated costs and expenses.
The above exceptions and limitations apply only to the extent permitted by law. Your statutory consumer rights cannot be excluded or limited.
Despite our efforts to ensure the security of our system, you acknowledge that all electronic data transmitted is subject to interception by others. We do not guarantee nor can we ensure that the data transmitted within the application or within communications sent or received by us will not be monitored or read by others.
Imkan is unable to verify the identity of all users of the store, nor do we verify their physical/financial intentions or scrutinize them.
Imkan does not verify, review, or monitor all information included. We are not a party to any contract for the sale or purchase of products advertised in the Imkan store (only if the order value is transferred to the store's account). We do not participate in any transaction between the buyer and the seller in any way, and we merely facilitate the sales process between the seller and buyer. Imkan is not an agent for any buyer or seller, and therefore, Imkan is not liable to anyone regarding the sale or purchase of any products advertised on the Imkan site. Additionally, Imkan will not be responsible for fulfilling any contractual obligations arising from the sale or purchase contract and will not be obliged to mediate between the parties to the contract.
Imkan will not be liable for any loss or damage of any kind arising from the services provided, including any site downtime or malfunction. Any business losses, including, but not limited to, loss or damage to profits, income, revenues, usage, production, expected savings, business, contracts, employment opportunities, or where Imkan aims to limit the personal liability of its employees and staff.
You acknowledge that Imkan is a limited liability entity; you agree and covenant that you will not file any personal claims against Imkan's officers or employees concerning any losses you incur in relation to the Imkan store or these terms and conditions (this does not limit or exclude Imkan's liability).
